These Terms of Service (“Terms”) are a legal agreement between you (“User,” “you,” or “your”) and FlexHaus, LLC (“FlexHaus,” “we,” “us,” or “our”).

By accessing or using www.flexhaus.co (the “Platform”), you agree to be bound by these Terms.

If you do not agree, you may not use the Platform.

FlexHaus operates a technology-enabled housing marketplace platform that:

• Connects guests with furnished housing
• Enables property owners and operators to list units
• Facilitates short-term and mid-term stays
• Coordinates services such as furnishing, logistics, and support

FlexHaus does not own, lease, or control properties listed on the Platform.

FlexHaus acts solely as an intermediary platform.

• Property owners and operators are independent providers
• Guests contract directly with property providers for stays
• FlexHaus is not a party to rental or lease agreements unless explicitly stated

FlexHaus does not guarantee:

• Accuracy of listings
• Availability of properties
• Condition or suitability of accommodations

Users are responsible for evaluating listings.

FlexHaus may source listings, availability, pricing, and booking functionality from third-party infrastructure and distribution systems and does not independently verify all listing data.

Your stay may involve third parties, including:

• Property managers
• Furnishing providers (e.g., CORT Furniture)
• Cleaning, maintenance, and logistics vendors

FlexHaus is not responsible for third-party services.

You agree to:

• Provide accurate and complete information
• Maintain the confidentiality of login credentials
• Be responsible for all activity under your account

You must be at least 18 years old to use the Platform.

When you make a booking:

• You agree to the terms set by the property owner/operator
• You authorize FlexHaus to facilitate the transaction

Payments may be:

• Processed by FlexHaus
• Processed by third-party payment providers
• Distributed between FlexHaus and property partners

All fees are:

• Non-refundable unless otherwise stated
• Subject to taxes and service fees

Pricing is dynamic and subject to change at any time.

FlexHaus is not responsible for pricing errors, synchronization issues, or event-based pricing fluctuations.

Cancellation policies are determined by:

• The property owner/operator
• The specific booking terms

FlexHaus may assist in dispute resolution but does not guarantee refunds.

You agree not to:

• Use the Platform for unlawful or fraudulent purposes
• Upload harmful or malicious code
• Misrepresent identity or booking intent
• Interfere with Platform operations
• Violate applicable laws

FlexHaus may suspend or terminate accounts for violations.

All Platform content, including software, branding, and design, is owned by FlexHaus or its licensors.

You may not:

• Copy, modify, or distribute content
• Reverse engineer or exploit the Platform

You retain ownership of content you submit.

You grant FlexHaus a worldwide, non-exclusive, royalty-free license to use such content for Platform operations and marketing.

The Platform may integrate with third-party systems.

FlexHaus:

• Does not control these systems
• Is not responsible for their availability or performance
• Is not liable for disputes involving third parties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”

FlexHaus disclaims all warranties, including:

• Accuracy of listings
• Availability of properties
• Reliability of services

FlexHaus does not warrant the accuracy of listings, pricing, or availability provided through third-party systems or integrations.

To the maximum extent permitted by law:

• FlexHaus is not liable for indirect, incidental, or consequential damages
• FlexHaus is not responsible for disputes between users and property providers
• Total liability shall not exceed amounts paid to FlexHaus in the prior six (6) months

You agree to indemnify and hold harmless FlexHaus from claims arising from:

• Your use of the Platform
• Your violation of these Terms
• Your interactions with third parties

FlexHaus may:

• Suspend or terminate access at any time
• Remove listings or content
• Cancel bookings in cases of fraud or policy violations

Your use of the Platform is subject to the FlexHaus Privacy Policy.

These Terms are governed by the laws of the State of Illinois.

Disputes shall be resolved through binding arbitration in Illinois, except where prohibited by law.

FlexHaus may update these Terms at any time.

Continued use of the Platform constitutes acceptance of updates.

• These Terms constitute the entire agreement
• Invalid provisions do not affect the remainder
• You may not assign rights without consent

FlexHaus utilizes third-party technology platforms and service providers to support Platform operations, including listing distribution, booking management, pricing synchronization, and payment infrastructure. These providers may include RedAwning.com (“RedAwning”) and similar partners (“Infrastructure Providers”).

Certain features of the Platform are powered by Infrastructure Providers.

• Listings, availability, and pricing may be sourced from or synchronized with such providers
• Booking and user data may be transmitted to these providers as necessary

Infrastructure Providers operate independently.

FlexHaus is not responsible for:

• Data accuracy from such providers
• System outages or failures
• Changes to third-party systems

Your agreement is solely with FlexHaus.

You are not entering into a contract with RedAwning or other Infrastructure Providers.

Certain services may be subject to requirements imposed by Infrastructure Providers.

By using the Platform, you agree:

• To comply with requirements reasonably communicated by FlexHaus
• That FlexHaus may update processes to align with such requirements

Nothing in these Terms creates a direct contractual relationship between you and any Infrastructure Provider.

FlexHaus shall not be liable for:

• Listing inaccuracies originating from Infrastructure Providers
• Booking conflicts or synchronization errors
• Failures outside FlexHaus’s direct control
